Legal Context For Open Innovations - Current Understanding
Volume: 7 | Issue no: 1-2016 | Pagination: 1-5
Businesses are increasingly shifting to open innovation business models to suit to adjust their intellectual property rights management strategy. Meticulously they require determining how to edge the traditional "closed innovation" model which is legally required to acquire IP rights with decentralized, open innovation processes. This paper focuses on several challenges in reconciling IP law with the need for open innovation. The requirement in open innovation requires openness in the exchange of IP related information. Open Innovation Projects involve multiple claim holders-as contributors, collaborators investors,, co-inventors. A proper governance structure is desirable to help the parties involved to prioritize their claims. Co-inventor, co-owner and co-creator are regulated by Intellectual property law, but does not regulate as to how these rights are managed and in what hierarchy.

Copyright Of The Revised Architecture For Improvement In The Design Of Data Structure Of The Tree To Enhance The Applicability
Author:Dr. Suryakant B Patil, Ms. Ketaki G Katre, Ms. Priyankaghegade, Dr. Preeti Patil
Volume: 5 | Issue no: 1-2014 | Pagination: 22-29
Intellectual Property Rights (IPR) is the emerging concept in the developing country like India, but the developed countries already taken major note of it. The major share of the asset values of the organizations from the developed countries is occupied by the IPR. In India the awareness has been increasing rapidly since last few years and so the scope is. When consider the data set we first need to distinguish between the structures designed and the elements in the data set (when we use the term 'data' we shall mean the content of the data set itself). Structural elements include things like the field names and a model for the data - the organization of these fields and their inter-relation.In data structures trees play major role from applicability point of view like Multicast Routing, Turing Machine, Graph Theory, CFG, Traversals, Enhancement of Network Life Time, Internal Network Characterization etc. Here we have proposed the revised architecture for the improvement in the design of the data structure of the tree. This improved design will turn up into the enhancement in the traversals, operations, time complexity along with the accessibility during executions. This will be the universal solution for the Binary tree as well as the general tree in the various applications by revising the structural design. The copyright of the same is in the pipeline through Associate Lawyer Ms. PriyaSomaiyya ofKatariya& Associates, a Patents & Trademarks Attorneys. As there are no general rules and the situation varies by Indian jurisdiction. Thus we proceed country by country detailing for (if any) this approach is used in a particular jurisdiction.

Author:Dr. Smita Sahu, Ritika Sharma
Volume: 5 | Issue no: 1-2014 | Pagination: 18-21
The issue of gene patenting has taken the centre stage of growing international community concern towards the recent decisions of the Supreme Court of the United States on Association for Molecular Pathology v. Myriad Genetics in context to the patentability of isolated genetic material and its analogues. Gene patenting including human gene and the intervened gene products which are biological in nature and is a part of many technologies, treatments, diagnostics, drugs, treatments etc, and the IP protection which provides them exclusive right and the reward for their intense contribution of technology to society, it also make the unavailability and more hindrances to the patients for getting maximum commercial benefits. These all are associated with the policies made by the concerned governing nation which considers the gene mere a chemical substance, a biological tool or a nature product. This paper extensively studies the world scenario on the nation specific IP policy overview and implications in the various spectrum of novelty criteria, biogenetic healthcare services, dissemination of research and innovations, concerns regarding the limitations on access to genetic testing to different economic strata, to address the broad area of gene patenting and their analogues as inclusive of cDNA, recombinant DNA etc.

Using pretested structured questionnaire, the primary data have been collected purposively, by covering the wide range of Features, Characteristics, and Comments from the randomly chosen two- hundred respondents from the study area. We have applied statistical tools such as descriptive statistics along with regression analysis to identify the factors determining facilities management and awareness of the facilities management among the selected respondents.
